Constable Gilvesy v Toronto PD
Excellent write up by Julius Ruechel. The article includes a partial copy of the Constable’s legal complaint. This could be helpful to other folks, as well, even if you don’t live in Canada. Most western countries have similar laws. For us it’s kind of a test case, as Trudeau has promised to ‘protect businesses’ from liability for firing workers who aren’t vaccinated.
We shall see.
That is a great read. Thank you.
And as you say, perhaps important to many. Make ’em fire you and during the process cite to them your specific legal complaints and objections.
Julius gets even better with every article he writes. So much of this applies in the US, in Australia, in the UK, in Germany, everywhere that still has an existing rule of law despite what our politicians are doing. Read it if only to encourage yourself that petty tyrants will indeed face their day of reckoning in the courts.
A few of my favourite bits below — but read the whole thing:
Tyranny collapses without minions.
Here’s the problem for all employers: whether it takes days, months, or years, the hysteria will eventually end, but these official complaints will not just go away — those committing offenses in the name of imposing vaccine mandates are going to have to answer to these charges someday in a court of law.
By making them fire you, they have to (1) confront the difficult moral choice of firing you and (2) you put them into a position where they may face serious legal repercussions (possibly even criminal accountability) for discriminating against you based on your medical status. Your employer cannot be sure that the government will protect them from the legal consequences of an illegal vaccine mandate.
By refusing to quit, you shift the tyranny into their shoes. By refusing to quit, you force them to take an active role in destroying someone’s career and in taking away someone’s ability to feed their family. It makes them get their hands dirty.
When this hysteria breaks, the top tier of our government will face human rights tribunals and may do hard time in prison. What they have done is not small potatoes.
While the community here would see the truth in this complaint — Uttering Threats, Punishment, Assault, Consent (or lack thereof), Torture, Extortion and Public Incitement of Hatred — I see 2 problems.
First, she doesn’t cite the examples of what the chief did that prove the above crimes.
Second, I had a few conversations with people today that really illustrated for me how a lot of people think that vaccine mandates and vaccines passports and masks mandates are all okay, if that’s what it takes to get life back to normal.
A lot of people are so fed up with how much our lives have changed and they think the only barrier to getting back to normal if getting everyone on board with following the rules.
I know that the majority are totally ignorant of all the science about managing this virus, problems with the vaccine, and the shocking infringements on our rights and freedoms. To them, the only way to manage the virus is 100% vaccination rates as soon as possible, and if you don’t like it, you should be locked up. The majority will see the constable’s letter as the rantings of a crazy person. Sigh.
Case law should be able to support at least some of the charges. But I am the farthest thing from a lawyer that can be imagined.
